Judge Walker deemed Prop 8 Unconstitutional based upon both the Equal Protection and Due Process clauses of the U.S. Constitution.  Here’s the full text of the 138 page decision.

  1. I'm about half way through reading that decisionn. The judge certainly didn't hold back criticism.

    It is interesting that _every single one_ of the California government officials sued, from the governor down to a couple of county clerks, _refused_ to defend proposition 8.

    Not touching that festering pile of fewmets with a ten foot pole was a wise decision by all of them for their future political careers.

    As a result, the religious zealots that originally pushed for Proposition 8 had to come in and defend it on their own. To say that they failed hilariously understates the matter.

    • I finished reading it, and the "Conclusion", down at the bottom by some coincidence, works as a "Cliff's Notes" version for those who don't enjoy slogging through legal decisions.
